歡迎使用「好眠日記」(Good Sleep Diary)。本應用程式(下稱「本 App」)由在英國註冊的公司 Peace and Hope Ltd.(下稱「我們」、「本公司」或「開發者」)所擁有與營運。
請仔細閱讀以下條款。當您下載、安裝、存取或使用本 App 時,即表示您已閱讀、理解並同意接受本《使用者授權與服務條款》(下稱「本條款」)的所有內容。如果您不同意本條款的任何部分,請勿下載、安裝或使用本 App。
第 1 條:總則與條款接受
1.1 條款範圍: 本條款構成您與本公司之間具有法律約束力的協議,規範您對本 App 的使用權利與義務。
1.2 平台條款: 本條款所規定的使用規則,不得與您下載 App 時所屬平台(Apple App Store 或 Google Play Store)當時有效的服務條款(例如《Apple 媒體服務條款與條件》或《Google Play 服務條款》)相衝突。您確認已有機會審閱並同意遵守前述平台條款。
1.3 條款修改: 我們保留隨時修改本條款的權利。修改後的條款將公佈於本 App 內或我們的官方網站,並於公佈時生效。若您在條款修改後繼續使用本 App,將視為您已接受修改後的條款。
第 2 條:重要免責聲明:本服務不提供醫療建議
2.1 非醫療機構: Peace and Hope Ltd. 並非醫療機構。好眠日記 App 所提供的服務,其目的並非、也絕不能被視為醫療執業或提供醫療照護。
2.2 資訊與教育目的: 本服務,包含 App 內所有的文字、圖形、影像和其他素材,僅為提供資訊與教育之目的而設計。其內容基於失眠認知行為治療(CBT-i)的原則,旨在幫助您追蹤與管理您的睡眠習慣。
2.3 尋求專業建議: **您絕不能將本 App 提供的資訊,視為取代您的醫師或其他專業醫療人員所提供之醫療建議的替代方案。**若您對任何醫療狀況有疑問,請務必尋求合格醫療專業人員的建議。切勿因為在本 App 上閱讀或體驗到的任何內容,而忽視專業醫療建議或延遲就醫。
2.4 無醫病關係: 使用本 App 不會在您與本公司之間建立任何形式的醫病關係。本 App 不提供任何形式的醫療診斷、治療或處方。
第 3 條:使用者帳戶與資格
3.1 年齡限制: 您必須年滿 18 歲才能使用本服務。
3.2 帳戶責任: 您可以透過電子郵件、社群媒體帳戶或以匿名訪客身份使用本 App。您有責任維護帳戶與密碼的安全,並為您帳戶下發生的所有活動負責。
第 4 條:訂閱、付款與續約
4.1 訂閱服務: 您可以透過 App 內購買訂閱我們的進階服務(下稱「Pro 版」)。我們提供月費和年費兩種訂閱方案,具體價格以 App 內顯示為準。
4.2 付款: 訂閱費用將在您確認購買時,透過您的 Apple ID (iTunes) 帳戶或 Google Play 帳戶收取。
4.3 自動續約: 您的訂閱將會自動續訂,除非您至少在當前訂閱期結束前 24 小時,前往您的帳戶設定中關閉自動續訂功能。
4.4 續約扣款: 您的帳戶將在當前訂閱期結束前的 24 小時內被收取續訂費用。
4.5 管理訂閱: 您可以在購買後,前往您的 Apple App Store 或 Google Play Store 的帳戶設定中管理您的訂閱並關閉自動續訂。
4.6 退款政策: 所有付款均為最終且不可退還。任何退款請求必須透過 Apple App Store 或 Google Play Store 的標準流程處理。根據平台政策,我們通常不為已使用的部分訂閱期間提供退款。
第 5 條:使用限制
您同意不會,也不會允許他人從事以下任何行為:
a. 將本 App 散佈或使其可在網路上供多個裝置同時使用(家人共享等平台允許的功能除外)。
b. 出售、轉售、出租、出借、轉讓、再分發或再授權本 App。若您將您的裝置出售給第三方,您必須在此之前從該裝置移除本 App。
c. 複製本 App(除非本授權及使用規則明確允許)。
d. 對本 App 或其任何部分進行反向工程、反編譯、拆解、試圖推導原始碼、修改或創建衍生作品(除非且僅在適用法律禁止前述限制的範圍內)。
e. 違反任何適用的法律或法規。
f. 侵犯我們或任何第三方的智慧財產權或其他權利。
g. 上傳或傳輸任何含有病毒、惡意軟體或有害程式碼的內容。
h. 進行任何可能損害、癱瘓、過載或影響本 App 正常運作的行為。
第 6 條:隱私與資料
6.1 隱私政策: 我們如何收集、使用、儲存和保護您的個人資訊受我們的《隱私政策》規範,該政策構成本條款的一部分。請務必查閱我們的《隱私政策》以了解詳細資訊。
6.2 技術數據: 您同意我們可能收集和使用匿名的技術數據及相關資訊(包括但不限於有關您的裝置、系統和應用程式軟體的技術資訊),這些資訊會定期收集,以利於為您提供軟體更新、產品支援及與本 App 相關的其他服務。只要這些資訊的形式不會識別您的個人身份,我們即可將其用於改進我們的產品。
第 7 條:智慧財產權
7.1 App 所有權: 本 App 本身及其所有相關權利,包括但不限於原始碼、目標碼、介面設計、視覺元素、圖形、商標、文字內容、功能以及所有相關的智慧財產權,均為本公司或其授權方的專有財產。本條款未授予您對本 App 的任何所有權。
7.2 第三方內容: 本 App 可能使用或整合第三方服務或內容(例如 Firebase)。這些第三方元件的權利歸屬於其各自的所有者,其使用可能受到相應的第三方條款約束。
第 8 條:服務變更與終止
8.1 服務變更: 我們保留隨時自行決定修改、暫停或終止本 App 的部分或全部服務、更改功能或調整價格的權利,無論是否事先通知。
8.2 使用者終止: 您可以隨時停止使用本 App,並從您的裝置中刪除。Pro 版訂閱用戶可以依照第 4.5 條所述,透過平台商店取消訂閱。
8.3 開發者終止權: 如果您未能遵守本條款的任何規定,您在本條款下的權利將自動終止,無需我們另行通知。此外,若您從事任何非法、欺詐或濫用行為,或出於技術、安全、法律等原因,我們保留隨時暫停或終止您存取權限的權利。
8.4 終止後果: 本條款終止後,您必須停止所有對本 App 的使用。第 7 條(智慧財產權)、第 10 條(擔保免責)、第 11 條(責任限制)以及其他依其性質應繼續有效的條款,在本條款終止後仍然有效。
第 9 條:維護與支援
開發者全權負責提供本條款中所指定的,或適用法律所要求的關於本 App 的任何維護與支援服務。您與開發者均認知,Apple 或 Google 沒有任何義務提供關於本 App 的任何維護與支援服務。
第 10 條:擔保免責 (Warranty Disclaimer)
10.1 按「現狀」提供: 您明確承認並同意,使用本 App 的風險由您自行承擔。在適用法律允許的最大範圍內,本 App 及透過本 App 提供的任何服務均按「現狀」(AS IS) 和「現有」(AS AVAILABLE) 提供,包含所有可能存在的故障,且不附帶任何形式的擔保。
10.2 免責聲明: 開發者特此聲明,不對本 App 及任何相關服務提供任何明示、暗示或法定的擔保和條件,包括但不限於對適銷性、特定用途適用性、準確性、及未侵權的擔保。我們不保證 App 的功能將滿足您的要求,或其運作不會中斷或沒有錯誤。
10.3 平台的有限責任: 若本 App 未能符合任何適用擔保,您可以通知 Apple 或 Google,平台方將會向您退還本 App 的購買價格(若有支付)。在適用法律允許的最大範圍內,Apple 或 Google 對於本 App 將不承擔任何其他擔保義務。
10.4 資料備份: 我們不對因使用或無法使用本 App 導致的任何資料遺失或損壞承擔責任。建議您定期自行備份儲存在本 App 中的重要資料。
第 11 條:產品索賠與責任限制
11.1 產品索賠: 您與開發者均認知,是開發者,而非 Apple 或 Google,負責處理您或任何第三方就本 App 或您使用本 App 提出的任何索賠,包括但不限於:(i) 產品責任索賠;(ii) 任何關於本 App 未能遵守適用法律或法規要求的索賠;以及 (iii) 根據消費者保護或隱私權法律提出的索賠。
11.2 責任限制: 在法律未禁止的範圍內,在任何情況下,開發者均不對因您使用或無法使用本 App 而引起的或與之相關的任何人身傷害或任何附帶的、特殊的、間接的或後果性的損害承擔責任。這些損害包括但不限於:利潤損失、資料遺失或損壞、業務中斷等。
11.3 責任上限: 在任何情況下,開發者因所有損害對您承擔的全部責任(涉及人身傷害的案件中適用法律可能要求的除外)不應超過您在導致索賠事件發生前十二個月內為使用本 App Pro 版服務實際支付的總金額,或者五十美元 ($50.00 USD)(以較高者為準)。
第 12 條:法律遵循與第三方受益人
12.1 法律遵循: 您聲明並保證:(i) 您不位於受美國政府禁運的國家,或被美國政府指定為「支持恐怖主義」的國家;且 (ii) 您未被列在任何美國政府的禁止或限制人員名單上。
12.2 第三方受益人: 您與開發者均認知並同意,Apple 及其子公司,以及 Google 及其關聯公司,均為本條款的第三方受益人。當您接受本條款後,Apple 和 Google 將有權利(且將被視為已接受該權利)作為第三方受益人對您執行本條款。
第 13 條:準據法與爭議解決
13.1 本條款之解釋與適用,以及因本條款而生或與之相關的任何爭議或索賠,均應以英格蘭及威爾斯法律 (the laws of England and Wales) 為準據法,但不適用其法律衝突原則。
13.2 對於因本條款引起或與之相關的任何爭議,雙方應首先嘗試透過友好協商解決。若協商不成,雙方同意將該爭議提交至英格蘭及威爾斯法院為專屬管轄法院 (exclusive jurisdiction of the courts of England and Wales)。

Good Sleep Diary End-User Licence Agreement and Terms of Service

Welcome to Good Sleep Diary ("好眠日記"). This application (the "App") is owned and operated by Peace and Hope Ltd., a company registered in the United Kingdom ("we", "us", "our", or the "Developer").
Please read the following terms carefully. By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by all the terms of this End-User Licence Agreement and Terms of Service (the "Terms"). If you do not agree with any part of these Terms, please do not download, install, or use the App.
1. General Provisions and Acceptance of Terms
1.1 Scope of Agreement: These Terms constitute a legally binding agreement between you and the Developer, governing your rights and obligations regarding the use of the App.
1.2 Platform Terms: The rules for using this App as set out in these Terms must not conflict with the terms of service of the platform from which you downloaded the App (e.g., Apple Media Services Terms and Conditions or Google Play Terms of Service), which you acknowledge you have had the opportunity to review and agree to comply with.
1.3 Modification of Terms: We reserve the right to modify these Terms at any time. Modified terms will be published within the App or on our official website and will become effective upon publication. Your continued use of the App after any such modification constitutes your acceptance of the new Terms.
2. Important Disclaimer: The Service Does Not Provide Medical Advice
2.1 Not a Medical Provider: Peace and Hope Ltd. is not a healthcare provider. The Service provided by the Good Sleep Diary App is not intended to be, and must not be taken to be, the practice of medicine or the provision of medical care.
2.2 Informational and Educational Purposes Only: The Service, including all text, graphics, images, and other material contained within the App, is designed for informational and educational purposes only. It is based on the principles of Cognitive Behavioural Therapy for Insomnia (CBT-i) to help you track and manage your sleep habits.
2.3 Seek Professional Advice: You must not rely on the information provided by this App as a substitute for professional medical advice from your doctor or other qualified healthcare provider. Always seek the advice of a qualified health professional with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or experienced on this App.
2.4 No Doctor-Patient Relationship: Use of the App does not create a doctor-patient relationship between you and the Developer. The App does not provide any form of medical diagnosis, treatment, or prescription.
3. User Accounts and Eligibility
3.1 Age Requirement: You must be at least 18 years of age to use the Service.
3.2 Account Responsibility: You may use the App by registering with an email, a social media account, or as an anonymous guest. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
4. Subscriptions, Payments, and Renewals
4.1 Subscription Service: You may subscribe to our premium service ("Pro Version") via in-app purchase. We offer monthly and annual subscription plans. The specific prices are displayed within the App.
4.2 Payment: Payment will be charged to your Apple ID (iTunes) account or Google Play account at the confirmation of purchase.
4.3 Automatic Renewal: Your subscription will automatically renew unless you turn off auto-renewal in your account settings at least 24 hours before the end of the current subscription period.
4.4 Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period.
4.5 Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your account settings in the Apple App Store or Google Play Store after purchase.
4.6 Refund Policy: All purchases are final and non-refundable. Any requests for refunds must be processed through the standard procedures of the Apple App Store or Google Play Store. In accordance with platform policies, we generally do not provide refunds for partially used subscription periods.
5. Usage Restrictions
You agree not to, and not to permit others to:
a. Distribute or make the App available over a network where it could be used by multiple devices at the same time (except as permitted by platform features like Family Sharing).
b. Sell, resell, rent, lease, lend, assign, redistribute, or sublicense the App. If you sell your device to a third party, you must remove the App from the device beforehand.
c. Copy the App (except as expressly permitted by this licence).
d. Reverse-engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the App or any part thereof (except and only to the extent that any foregoing restriction is prohibited by applicable law).
e. Violate any applicable laws or regulations.
f. Infringe upon our or any third party's intellectual property rights or other rights.
g. Upload or transmit any content containing viruses, malware, or harmful code.
h. Engage in any activity that could damage, disable, overburden, or impair the proper working of the App.
6. Privacy and Data
6.1 Privacy Policy: How we collect, use, store, and protect your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for details.
6.2 Technical Data: You agree that we may collect and use anonymous technical data and related information (including but not limited to technical information about your device, system and application software, and peripherals) that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the App. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you.
7. Intellectual Property
7.1 Ownership of the App: The App itself, and all rights therein, including but not limited to source code, object code, user interface design, visual elements, graphics, trademarks, text, features, and all related intellectual property rights, are the exclusive property of the Developer or its licensors. These Terms do not grant you any ownership rights in the App.
7.2 Third-Party Content: The App may use or integrate third-party services or content (e.g., Firebase). The rights to such third-party components belong to their respective owners, and their use may be subject to corresponding third-party terms.
8. Service Changes and Termination
8.1 Changes to Service: We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects (including features and pricing), with or without notice.
8.2 Termination by You: You may stop using the App and delete it from your device at any time. Users of the Pro Version may cancel their subscription as described in Section 4.5.
8.3 Termination by Developer: Your rights under these Terms will terminate automatically without notice from us if you fail to comply with any of its provisions. Furthermore, we reserve the right to suspend or terminate your access at our sole discretion if you engage in any illegal, fraudulent, or abusive activity, or for technical, security, or legal reasons.
8.4 Consequences of Termination: Upon termination, you must cease all use of the App. Sections 7 (Intellectual Property), 10 (Warranty Disclaimer), 11 (Limitation of Liability), and other provisions that by their nature should survive, shall survive any termination.
9. Maintenance and Support
The Developer is solely responsible for providing any maintenance and support services for this App as specified in these Terms or as required under applicable law. You and the Developer acknowledge that neither Apple nor Google has any obligation whatsoever to furnish any maintenance and support services with respect to the App.
10. Warranty Disclaimer
10.1 "AS IS" BASIS: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ANY SERVICES PERFORMED OR PROVIDED BY THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
10.2 DISCLAIMER: THE DEVELOPER HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, AND OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE APP WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.
10.3 PLATFORM'S LIMITED LIABILITY: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and the respective platform will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, neither Apple nor Google will have any other warranty obligation whatsoever with respect to the App.
10.4 DATA BACKUP: We are not responsible for any loss or corruption of data resulting from the use or inability to use the App. You are strongly encouraged to back up your important data independently.
11. Product Claims and Limitation of Liability
11.1 Product Claims: You and the Developer acknowledge that the Developer, not Apple or Google, is responsible for addressing any claims of the end-user or any third party relating to the App or the end-user’s possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
11.2 LIMITATION OF LIABILITY: TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
11.3 LIABILITY CAP: IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE AMOUNT OF FIFTY U.S. DOLLARS ($50.00) OR THE TOTAL AMOUNT YOU ACTUALLY PAID FOR THE PRO VERSION OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
12. Legal Compliance and Third-Party Beneficiary
12.1 Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
12.2 Third-Party Beneficiary: You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, as well as Google and its affiliated companies, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, they will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
13. Governing Law and Dispute Resolution
13.1 Governing Law: These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
13.2 Dispute Resolution: The parties shall first attempt to resolve any dispute arising out of or relating to these Terms through friendly negotiations. If the dispute cannot be settled by negotiation, the parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

15. General Provisions
15.1 Entire Agreement: These Terms and the referenced Privacy Policy constitute the entire agreement between you and the Developer regarding the use of the App and supersede all prior or contemporaneous oral or written agreements on that subject matter.
15.2 Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.
15.3 Waiver: The failure of the Developer to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
